Snapfish Publisher - Business Terms

The following terms are in addition to the Snapfish Publisher Terms & Conditions, the terms of which are incorporated by reference into these Business Terms.
  • Definitions
    • Terms which are defined in the Snapfish Publisher Terms & Conditions and used in these Business Terms shall have the same meaning as in the Snapfish Publisher Terms & Conditions except if otherwise defined herein. In addition, the following terms have the meanings indicated below:
    • Snapfish Retail Price: is the price published on Snapfish Sites in each country for each Product sold by Snapfish outside the SP service
    • Snapfish Base Price: is the price defined by Snapfish in each country for each Product above which royalty compensation is determined
    • Premium: a nominal amount of money added to the Snapfish Retail Price
    • Combined Retail Price: is the price paid by the end customer for each Product sold through the SP service and equals the sum of the Snapfish Retail Price plus any applicable Premiums
    • Registered Country: the country selected by the SP Member during registration in which currency the SP Member will be paid
  • Model
    • Assets
      • A Premium will be added onto Sanpfish's Base Price for your Assets such that the Combined Retail Price paid by the end customer equals the sum of the Snapfish Retail Price plus your Premium. Snapfish will choose the Premium that you will be paid, in its sole discretion, based upon design and market expectations, at the rates set forth in Section 6 in accordance with your design's rating as "Plus" or "Premium".
    • Products
      • A Premium will be added onto Snapfish's Base Price for your Products such that the Combined Retail Price paid by the end customer equals the sum of the Snapfish Retail Price plus your Premium. Snapfish will choose the premium that you will be paid based upon design and market expectations.
    • General
      • Taxes including sales tax, VAT and GST will be excluded from royalty calculations. For example if your Premium is set at 1.00 EUR in a country where 10% VAT is included in retail prices the end customer will pay 1.10 EUR and your royalties will be 70% x 1.00 EUR = 0.70 EUR for each unit sold.
      • Returns and refunds will be excluded from royalty calculations. For example if your Premium is set at $1.00 USD, 10 units are sold, and 1 unit is returned or refunded your royalties will be 70% x $1.00 x (10 - 1) = $6.30.
  • Discounting
    • Snapfish may offer promotional or other discounts that affect price and royalties for Assets and Products. In such cases the same discount percentage will apply to Snapfish Retail Prices, Snapfish Base Prices, and your Premiums.
    • For example assume the Snapfish Retail Price is $10.00 and your Premium is $2.00 for an Asset. If Snapfish offers a 25% discount the end customer will pay 75% x ($10.00 + $2.00) = $9.00 and your royalties will be 75% x 70% x $2.00 = $1.05.
    • Similarly, assume the Snapfish Base Price is $10.00 and the Snapfish Retail Price is $11.00 and your Premium is $2.00 for a Product. If Snapfish offers a 50% discount the end customer will pay 50% x ($11.00 + $2.00) = $6.50 and your royalties will be 50% x 70% x ($11.00 + $2.00 - $10.00) = $1.05.
    • For certain types of promotions such as "buy one get one free" the discount rate may reach 100%. Your royalties will be zero for units sold at a 100% discount.
  • Payment
    • General
      • You must be a registered SP Member with a valid mailing address to receive payments. In applicable countries you must also provide tax information to Snapfish, through the registration process and when requested, prior to receiving payments.
    • Timing and calculation
      • There will be one payment cycle per month. Payments will be based on orders processed by Snapfish during that month using the remuneration model described in Sections 2 and 3.
      • If your total royalties for the month fall below the minimum threshold for your Registered Country, payment will be deferred to future cycles until your cumulative earnings exceed the threshold. Minimum thresholds are shown in Section 5 below.
      • Payment will be issued up to 45 days after the end of the payment cycle. The method of payment will depend on your Registered Country as shown in Section 5 below. The transaction fees shown in the table will be deducted from your payment, and you will be responsible for any additional fees which may be levied by your receiving bank.
      • Upon termination Snapfish will pay you any net outstanding royalties after deducting transaction fees.
      • Your payment may be subject to tax withholding if applicable for your Registered Country.
    • Foreign exchange
      • You will be paid in the local currency of your Registered Country, which may be different than the country or countries in which your Assets or Products are sold.
      • If your Assets or Products are sold in a different currency than your payment, Snapfish will use its standard worldwide monthly exchange rates for conversion. These standard worldwide monthly exchange rates will also be used to convert transaction fees and monthly minimums into the currency of your payment.
